Employment Discrimination

Federal law, Title VII, prohibits some employers from discriminating against workers and job candidates on the basis of race, color, religion, sex and national origin. This law also protects employees that oppose illegal discriminatory practices at work.

The Fair Labor Standards Act. (the "FLSA") sets the federal minimum wage and overtime pay for employers. An employers failure to follow the FLSA can result in: unpaid minimum and/ or overtime wages; employee missclassification; off-the-clock work; time or pay deductions;

Family Medical Leave

The Family Medical Leave Act (the "FMLA") allows some employees to take up to 12 weeks of unpaid leave per 12-month period to attend to personal medical issues or the medical needs of an immediate family member. After taking FMLA leave, an employee must be allowed to return to their position with the same pay.

Employment Agreement and Severance

Mississippi is an "at-will" employment state. This means that an employer can legally terminate an employee, with or without a cause on a non-discriminatory basis. Despite the state's "at-will" law, there are some instances where an employer may present an employee with an employment or severance agreement
